1. Acceptance of Terms

By accessing or using LoveStamp ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

LoveStamp provides a platform for users to create and permanently store love notes on the Bitcoin blockchain using the OP_RETURN field. The Service includes:

• AI-powered validation of love notes
• Blockchain transaction creation and broadcasting
• Payment processing for mainnet transactions
• Free testnet transactions for testing purposes

3. User Responsibilities

3.1 Acceptable Use

You agree to use the Service only for lawful purposes. You must NOT:

• Submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Submit content that infringes on intellectual property rights, privacy rights, or any other rights of third parties
• Submit spam, commercial advertisements, or promotional materials
• Attempt to circumvent AI validation or abuse the Service
• Use automated systems (bots, scripts) without authorization
• Interfere with or disrupt the Service or servers

3.2 Content Responsibility

You are solely responsible for the content you submit. We do not pre-screen content (beyond AI validation for love note authenticity), and we do not endorse any content submitted by users.

5.1 Pricing

• Bitcoin Mainnet: $25 USD per LoveStamp (may vary based on promotions)
• Bitcoin Testnet: Free (for testing purposes only)

5.2 Payment Processing

All payments are processed securely through Stripe. We do not store your payment card information. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy.

6. Intellectual Property

6.1 Service Ownership

The Service, including its design, code, branding, and functionality, is owned by LoveStamp and protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

You retain all rights to the content you submit. However, by submitting content to be stored on the blockchain, you acknowledge that it becomes publicly accessible and permanently stored in a decentralized system beyond our control.

7. Disclaimers and Limitations

7.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy or reliability of blockchain data
• Security of data transmission

7.2 Blockchain Risks

You acknowledge that blockchain technology involves inherent risks, including:

• Transaction delays or failures due to network congestion
• Higher transaction fees during peak network usage
• Permanent loss of data if blockchain infrastructure fails (highly unlikely)
• Public visibility of all blockchain data

7.3 AI Validation

Our AI validation system is designed to verify that content is a love note, but it is not perfect. We do not guarantee 100% accuracy and reserve the right to refuse service for any content that violates our policies.

8. Limitation of Liability

To the maximum extent permitted by law, LoveStamp and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Service interruption or security breaches
• Errors in blockchain transactions
• Emotional distress or reputational harm

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless LoveStamp and its affiliates from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Service

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination:

• Your right to use the Service immediately ceases
• You remain liable for any outstanding payments
• Blockchain data already recorded remains permanent and public
• Provisions regarding liability, indemnification, and dispute resolution survive termination

11. Governing Law and Disputes

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LoveStamp regarding the Service.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
